JUSTICE MOHIT KUMAR SHAH ORAL ORDER 27-07-2022 The limited prayer of the petitioner is to direct the respondent no. 4 to dispose off the encroachment case bearing Encroachment Case No. 1 of 2019-20, initiated by the respondent no. 4 i.e. the Circle Officer, Vijaipur Circle, Gopalganj.

The learned counsel for the respondent-State submits

Patna High Court CWJC No.2064 of 2021(2) dt.27-07-2022 2/2 that the respondents would definitely take appropriate action, in accordance with law and pass appropriate orders under the provisions of the Bihar Public Land Encroachment Act, 1956 (hereinafter referred to as the 'Act, 1956') after hearing the affected parties.

Accordingly, the present writ petition stands disposed off with a direction to the respondent no. 4 to conclude the proceedings of the aforesaid encroachment case and pass final order under Section 6(1) of the Act, 1956, within a period of 12 weeks of receipt/production of a copy of this order. It is needless to state that in case the respondent no. 4 comes to a finding that encroachment has been made over public land, the same shall be removed forthwith. (Mohit Kumar Shah, J) S.Sb/- U
