The petitioners apprehend their arrest in Buxar (T) P.S. Case No. 561 of 2016 registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant alleged that when he went to saw the filling of earth the petitioners and others came having different weapons and assaulted the informant and his family members. Shri Jagdish Prasad, learned counsel for the petitioners submits that the case was lodged on false allegations. The dispute has already been resolved through Panchayati vide Annexure-4 of the bail petition but, it appears from perusal of the FIR and the
Patna High Court Cr.Misc. No.10871 of 2017 (6) dt.29-06-2017 2/2 case diary that the petitioners made indiscriminate assault to the informant and his family members who got injuries on different parts of their body.
Considering the facts aforesaid and nature of allegations made against the petitioners, I am not inclined to enlarge the petitioners above named on anticipatory bail. Accordingly, the same is rejected.
