JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-09-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Hilsa P.S. Case No. 242 of 2016 registered under Sections 304(B) and 201/34 of the Indian Penal Code.

The accusation is of killing of daughter of informant by her husband and in-laws due to non-fulfillment of demand of motorcycle and her dead body was disposed of. Learned counsel for the petitioners submits that, in fact, the daughter of informant died due to snake biting and thereafter her dead body was disposed of on giving information to

No.38749 of 2016 (2) dt.23-09-2016 the informant but due to ulterior motive the informant has lodged this case implicating the petitioners, who are brother-in-law, father-in-law and mother-in-law of the deceased. Moreover, Shiv Kumar, husband of the deceased, is already in custody and the informant has filed an application before the Additional Chief Judicial Magistrate, Hilsa, Nalanda, to the effect that his daughter has died due to snake biting.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Hilsa, Nalanda, in connection with Hilsa P.S. Case No. 242 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
