The petitioner apprehends his arrest in Gogari P.S. Case No. 2 of 2017 registered for the offences punishable under Section 354(D) of the Indian Penal Code and under Sections 66 and 67 of the I.T. Act.
The informant in her written statement alleged that the petitioner opened facebook account in her name and posted her photographs. The petitioner also alleged to have posted obscene photographs of the informant in order to blackmail her. Learned counsel for the petitioner submits that the petitioner is friend of the informant. The petitioner was studying with the informant. The informant handed over her mobile and memory card to the petitioner. The memory card was containing

It is further submitted that the petitioner got job as computer operator and the informant wanted to marry with the petitioner but the petitioner denied to solemnize marriage and that is why the informant lodged this false case making absurd allegation but it appears that the informant made specific allegation that the petitioner taking advantage of the intimate relation with the informant misuse the memory card and the mobile of the informant and opened facebook account in the name of Mannat Jaiswal and Rishu Choudhary and downloaded obscene photographs of the informant.
Considering the facts aforesaid and nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
