JUSTICE AJAY KUMAR TRIPATHI ORAL ORDER 16-08-2016 A deliberate mischief has been made on behalf of the petitioner for grant of one relief or the other when all such issues now have to be decided by a Civil Court of competent jurisdiction and the Civil Court has decided to appoint a receiver as well in such dispute.

In view of the above, this Court is not willing to give any tactical advantage to any of the claimants or disputants to the said dispute in any other proceeding. Whatever has to emerge must emerge in the title suit itself and no collateral litigation should be encouraged or entertained. Writ application is dismissed.
