1. Heard the learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in connection with Baniyapur P.S. Case No. 430 of 2021 registered for the offence under Sections 30(a)/41(I) of Bihar Prohibition and Excise Act, 2016.

3. As per the prosecution case, total 152 liters of country made liquor has been recovered from the vehicle in question.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 13.04.2023, he is quite innocent and has not committed any offence.

5. Learned A.P.P. has vehemently opposed the

Patna High Court CR. MISC. No.45940 of 2023(2) dt.04-08-2023 2/2 prayer for bail.

6. Considering the recovery of liquor, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Saran at Chapra /concerned Court below in connection with Baniyapur P.S. Case No. 430 of 2021.
