2. Petitioner apprehends arrest in a case registered for the offence punishable under section 392 of Indian Penal Code . 3 . As per the prosecution case , while the informant was returning from Purnea and reached near Bhairyahi bridge , four miscreants riding on two motorcycles intercepted his vehicle and took away Rs. 10,000/- and two mobile phones from him .

4. Learned counsel for the petitioner submits that petitiokner is not named in the FIR. The name of petitioner transpired on the basis confessional statement of other coaccused persons . Except confessional statement, there is nothing on record to show the complicity of this petitioner in the

Patna High Court CR. MISC. No.46567 of 2025(2) dt.11-08-2025 2/2 alleged occurrence . No looted article has been recovered from the possession of this petitioner.

5. Learned counsel for the State opposes the prayer for bail and submits that petitioner along with other co-accused have committed the alleged occurrence . Petitioner has got 2 criminal antecedents.

6. Considering the nature of accusation , criminal antecedents of these petitioners and gravity of offence , prayer for pre-arrest bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Koushik/- U T
