JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-04-2017 Heard learned counsel for the petitioner and the State. The present application has been filed for modification of the order dated 23.11.2015 passed in Criminal Miscellaneous No.53312 of 2015 to the extent of extending the period of provisional bail.

The petitioner was granted provisional anticipatory bail for two months on readiness to make payment of the cost of the alleged paddy procured. The provisional anticipatory bail of the petitioner was to be confirmed by the learned Court below if the claimed amount of the farmers will be refunded by the petitioner.

Since for modification of the order dated 23.11.2015, the present modification application was filed on 06.04.2017 and the period of provisional bail of petitioner has lapsed on 22.11.2016, this Court is not inclined to modify the

Patna High Court Cr.Misc. No.17188 of 2017 (2) dt.19-04-2017 2/2 order.

Accordingly the modification application is disposed of.

However, let the learned Court below consider the prayer for regular bail of the petitioner if the petitioner surrenders within a period of six weeks in connection with Kajraili P.S. Case No.46 of 2015, pending before the learned Judicial Magistrate, 1st Class, Bhagalpur.
