JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-07-2019 This is an application for grant of bail in connection with S.T. No. 184 of 2019, arising out of Nawada Town P.S. Case No. 160 of 2019, disclosing offences under Sections 341, 323, 354B, 376, 419, 504, 506, 313 of IPC and Section 66(E) of Information Technology Act, 2000.

Earlier prayer for bail of the petitioner was rejected by this Court, vide order dated 21.05.2019 passed in Criminal Misc. No.24257 of 2019 with liberty to the petitioner to move after framing of the charge.

Allegation against the petitioner is that after having physical relationship, when she became pregnant, petitioner got the pregnancy aborted and also taken obscene photograph of the informant and made viral.

Submission of learned counsel for the petitioner is that F.I.R. itself shows that she was a consensual party and he is

Patna High Court CR. MISC. No.41448 of 2019(2) dt.11-07-2019 2/2 in custody for more than five months and the charge has already been framed, which will appear from the Annexure 3 at Page17. Heard learned APP also.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I-Cum-Special Judge, Nawada, in connection with S.T. No. 184 of 2019, arising out of Nawada Town P.S. Case No. 160 of 2019, with condition that he has to co-operate in disposal of the trial and appear as and when required.

With the above observations, this application is allowed.
