JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-07-2018 Petitioner apprehends his arrest in connection with Chand P.S.Case No. 5 of 2018 registered for the offences punishable under Sections 302, 120B and 34 of the Indian Penal Code and Section 27 of the Arms Act.
Petitioner is not named in the FIR and later on his name transpires in the written application given by the informant. Submission of learned counsel for the petitioner is that investigation is going on against the petitioner. Learned APP has submitted that processes under Sections 82 and 83 Cr.P.C. have been issued against the petitioner, as such, this application is not maintainable.
Having heard both sides and in the facts and circumstances, let the petitioner, above named, surrender and pray
Patna High Court Cr.Misc. No.18542 of 2018 (4) dt.05-07-2018 2/2 for regular bail, which shall be considered on its own merit, without being prejudiced by this order.
