The petitioner is apprehending his arrest in connection with Nawada Town P.S.Cae No.731 of 2016 registered for offences punishable under Section 302 of the Indian Penal Code. Petitioner is not named in the FIR and later on his name has transpired during the course of investigation of the case. Submission of the learned counsel for the petitioner is that except suspicion there is absolutely nothing against the petitioner and though he is accused in one more case but in that case his name transpired on confession.
Heard learned A.P.P. and the learned counsel for the informant..
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.19476 of 2018 (3) dt.25-04-2018 2/2 circumstances, as stated above, this application is disposed fo with direction to the petitioner to surrender before the learned court below within a period of four weeks from the date of receipt of the order and on his surrender he will be released on bail till submission of the charge-sheet with condition that he will cooperate in investigation of the case and once the charge-sheet is submitted and the case is found true against the petitioner, he will make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court.
