The petitioners apprehend their arrest in connection with Garhpura P.S. Case no. 80 of 2016, registered under Sections 323, 341, 307, 379 and 504/34 of the Indian Penal Code. The accusation is that on 05.12.2016, the informant was engaged in the construction of the drain. At that time, petitioners along with one Pintu Kumar armed with lathi, danda and iron rod reached there and started to abuse making complaint that why the drain was being constructed. On raising alarm by the informant, Rakesh Ranjan, brother of the informant, rushed to save him then on the order of petitioner No.1 Umesh Das, co-accused Pintu Kumar caused injury at the head of his brother through iron rod, who fell down and become
Patna High Court Cr.Misc. No.13390 of 2017 (2) dt.01-05-2017 2/2 unconscious. At that time, petitioner No.3 Bablu Kumar snatched golden chain from the neck of the informant.
Learned counsel for the petitioners submits that there is specific allegation against Pintu Kumar, who caused blood oozing injury at the head of Rakesh Ranjan, brother of the informant. Further submission is that petitioners have no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub-Judge-VI-cum-Chief Judicial Magistrate, Begusarai in connection with Garhpura P.S. Case No. 80 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
