JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-03-2017 Heard learned counsel for the petitioners and learned APP for the State.
The petitioners are apprehending their arrest in connection with Araria Mahila P.S. Case No. 112 of 2016 registered for the offences punishable under Sections 376, 511 and 379/34 of the Indian Penal Code.
It has been submitted on behalf of the petitioners that there is no allegation for the offence under Section 376 IPC against the petitioners, rather petitioners have been falsely implicated in this case as prior to filing of the present case a complaint case was lodged by the petitioners against the informant of this case and earlier also a large number of cases were going on
Patna High Court Cr.Misc. No.10164 of 2017 (2) dt.18-03-2017 2/2 between the parties.
Having heard both sides and in view of the submissions made, let petitioners surrender and make prayer for regular bail, which shall be considered by the learned court concerned, taking into consideration the submission made as well as materials available in the case diary and will pass an appropriate order, without being prejudiced by this Court.
