The petitioner seeks bail in Benipatti P.S. Case No. 160 of 2021, G.R. No. 1300 of 2021, registered for the offence under Sections 272, 273/34 of the Indian Penal Code and Sections 30(a), 41, 44 of Bihar Prohibition and Excise Act. 279 liters & 750 ml. of illicit foreign liquor has been recovered from the house of co-accused Lila Devi. It is submitted on behalf of petitioner that neither the petitioner was apprehended on spot nor he is named in the F.I.R. and nothing has been recovered from his conscious possession. Petitioner is in custody since 22.08.2021. Investigation is complete.

Learned A.P.P. for the State has opposed the bail petition.

Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge II cum Special Judge Excise Act, Madhubani in connection with Benipatti P.S. Case No. 160 of 2021, corresponding to G.R. No. 1300 of 2021.
