The petitioners apprehend their arrest in Punaura P.S. Case No. 96 of 2021, registered for the offences punishable under Sections 363, 366(A) of the Indian Penal Code. As per the FIR, all the accused persons including petitioners are alleged to have kidnapped the minor daughter of

Patna High Court CR. MISC. No.55827 of 2021(3) dt.28-06-2022 2/2 informant.

It is submitted that the victim girl has not taken name of petitioners and specific allegation of kidnapping is against other co-accused persons. It is further submitted that the alleged occurrence took place on 08.06.2021, but the FIR was lodged on 14.06.2021 ie. after delay of six days without any plausible explanation. The present case is counter blast of complaint Case No. C1-750/2021 which was filed by Kanti Devi (petitioner no.

1) against informant and others for assaulting his son. Considering the facts aforesaid and statement of victim girl under Section 164 Cr.P.C, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Punaura P.S. Case No. 96 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
