The petitioners apprehend their arrest in connection with Tarabari P.S. Case No. 70 of 2017, registered under Sections 304(B) and 201/34 of the Indian Penal Code, pending in the court of S.D.J.M., Araria.

Admittedly, the prayer for pre-arrest bail of the petitioners was earlier rejected on merit vide order dated 11.01.2018 passed in Criminal Misc. No. 53409 of 2017. Learned counsel for the petitioners submits that petitioners are father-in-law and mother-in-law of the deceased, Anjum Ara, daughter of the informant. After investigation,

Patna High Court CR. MISC. No.43605 of 2019(2) dt.17-07-2019 2/2 police submitted the charge sheet against Md. Sayed, husband of the deceased, who after facing the trial in Sessions Trial No. 66 of 2018 has been acquitted on 18.01.2019 by the court of Additional Sessions Judge-III, Araria.

Having considered the facts and circumstances of the case and the nature of allegation against the petitioners, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, their prayer for grant of anticipatory bail stands rejected. The petitioners are directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
