Learned counsel for the State is not present. The petitioner apprehends his arrest in Samastipur Town (M) P.S. Case No. 448 of 2011 instituted for the offence under Sections 420 and 406/34 of the Indian Penal Code. It is alleged in the written report that Branch of Share Microfin Limited was running in the house of SS Thakur in front of Income Tax office, Tajpur Road, Dharampur, Distt. Samastipur. The company is registered by the RBI. The company after forming a group of ladies used to advance loan amounting to Rs.20,000/- As per circular of the company, the loan has to be re-paid in 50 equal installments. It is further alleged that six employees after hatching conspiracy, created forged documents in the name of fake persons, got advance of Rs.34,06,232/- from the company.

The other co-accused with similar allegation has already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 28.11.2013 passed in Cr. Misc. 19560 of 2013.
In this manner, there is vague allegation made by the informant. There is no mention of any specific name of the depositor or the loanee of making complain about misappropriation of money by petitioner.
Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Samastipur Town (M) P.S. Case No. 448 of 2011, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Samastipur, subject to the conditions as laid down under Section 438 (2) Cr.
