The petitioner has preferred this application for grant of regular bail in a case registered under sections 302 and 34 of the Indian Penal Code.
As per the prosecution case, on the orders of the petitioner it is stated that his sons assaulted Sunil Kumar with knife. On the informant going to his rescue, it is stated that the petitioner assaulted the informant.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. So far as the deceased Sunil Kumar is concerned, no overt act is alleged against this petitioner. With respect to the informant

Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, the petitioner not having been said to have assaulted the deceased Sunil Kumar and having remained in custody for 11 months, the Court directs the petitioner to be enlarged on bail in connection with Sahebganj P.S. Case no. 217 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st (West), Muzaffarpur.
