JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-08-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 341, 342, 353 and some other minor Sections of the Indian Penal Code. As per the prosecution case, all the villagers, including this petitioner, assembled and started fighting with the police personnel and did not allow the police vehicle to move away from their village and when additional police force came they fled away.

Learned counsel appearing for the petitioner submits that no specific overt act has been alleged against this petitioner and he has been made accused only because in the ruckus he fled away leaving his motor cycle. Petitioner has got clean

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Danapur, Patna in connection with Dulhin BazarPS case No. 91/ 2021, subject to conditions laid down u/s 438(2) of the Cr.
