The present application has been filed for modification of the order dated 03.09.2015 passed in Criminal Miscellaneous No.35137/2015 in connection with Taraiyan P.S. Case No.91/2010(S.T. No.716 of 2011), pending before the learned Additional Sessions Judge-IV, Saran at Chapra, registered for the accusation under sections 147, 148, 149, 323, 324, 325, 326, 307 and 302 of the Indian Penal Code, whereby the petitioner was granted anticipatory bail, with a liberty to the learned court below to cancel the bail bonds of the petitioner in case the petitioner defaults without any reasonable cause on three consecutive occasions.
It is submitted by learned counsel for the petitioner that since the petitioner is suffering from several ailments hence he prays for exemption of personal appearance before the learned
Patna High Court Cr.Misc. No.17171 of 2017 (2) dt.19-04-2017 2/2 court below.
There is nothing on record to suggest that the petitioner preferred any such application before the learned Court below.
It is needless to say that if any such application is filed, the learned Court below will see the reasonability of exemption from personnel appearance and will pass appropriate order in accordance with law.
With the above observation, this application is disposed of.
