JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-06-2021 Heard Mr. Ravish Mishra, learned advocate for the petitioner and Mr. Ajay Kumar Jha, learned APP for the State. Mr. Mishra, learned counsel for the petitioners seeks permission to withdraw this petition with respect to petitioner no. 1, who has been arrested.
This petition with respect to petitioner no. 1 / Digvijay Singh stands dismissed as withdrawn. The petitioner no. 2 seeks bail in anticipation of her arrest in connection with Bidupur P.S. Case No. 30 of 2020, instituted for the offences under Sections 304(B)/201/34 of the Indian Penal Code.
The petitioner no. 2 is the mother- in- law of the
Patna High Court CR. MISC. No.40154 of 2020(2) dt.10-06-2021 2/3 deceased and it has been submitted on her behalf that she being an old lady has only been made accused in this case because of her relation with the husband of the deceased. The petitioner along with her husband had been staying separately from the deceased and her husband for a long time. Apart from this, it has been submitted that the marriage took place in the year 2015 and it does not appear to be probable that there would be a demand of dowry in the year 2020. It has also been brought to the notice of this Court that the deceased had been administered treatment but she succumbed to her illness and died a natural death. A discharge slip from the hospital also has been brought on record to substantiate the argument urged on behalf of petitioner no. 2.
The husband of petitioner no. 2 has been granted bail by the court below. The husband of the deceased also appears to have been granted bail by the court below. Considering the afore-stated set of facts, the petitioner no. 2/Sheela Devi is directed to be released on bail, in the event of her arrest or surrender before the Court below within a period of eight weeks from the date of receipt/ production of a copy of this order, on furnishing bail bonds of Rs.10,000/- (Rs. Ten Thousand) each with two sureties of like
