The petitioner seeks regular bail in connection with Nabinagar Police Station Case No. 145 of 2021, registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
The prosecution case, as per the First Information Report, is that the police intercepted one motorcycle, being driven by the petitioner, and recovered 75 litres of illicit country-made liquor from the same.
Learned Counsel for the petitioner submits that the petitioner has falsely been implicated by the police with oblique motive and at the time of search and seizure, the procedure prescribed under the provisions of the Code of Criminal Procedure and the Bihar Prohibition and Excise Act, 2016 , has

He further submits that the petitioner is in custody since 29.06.2021, having no criminal antecedent and charge sheet has been submitted against him and as such, there is no likelihood that the petitioner will abscond and/or tamper with the evidence.
Regards being had to the submissions advanced on behalf of the parties concerned and taking into consideration the materials available on record and the fact that charge sheet has already been submitted and the petitioner is in custody since 29.06.2021, having no criminal antecedent, I am inclined to grant regular bail to the petitioner.
This application is, accordingly, allowed.
Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge -cum- Special Judge, Excise, Aurangabad, in connection with Nabinagar Police Station Case No. 145 of 2021.
