Learned counsel for the petitioner undertakes to remove the defects within three weeks of resumption of normal court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.

The petitioner seeks bail in a case registered for the offence punishable under Sections 498A, 323, 504, 506, 341, 307, 34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

Petitioner in association of his family members always used to torture the informant for non-fulfillment of dowry demand.

Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.39804 of 2020(5) dt.26-03-2021 2/2 petitioner is innocent and has been falsely implicated in this case. He submits that petitioner filed a divorce suit in the Court of learned Principal Judge, Nalanda, Biharsharif being Divorce Case No. 187 of 2019. The said divorce suit was filed on 24.06.2019 and the notice was issued to the informant. He submits that when the summons were issued with the divorce suit, thereafter, the informant filed the present FIR. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application and he is languishing in judicial custody since 05.06.2020.

In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Nalanda in connection with Mahila P.S. Case No. 189 of 2019.
