1. Heard learned counsel for the petitioner and learned APP for the State.
2. At the outset, learned counsel for the petitioner seeks permission to make necessary correction in paragraph No. 3 of the petition with regard to the Section of the offence which has been shown as petitioner's criminal antecedent.
3. Permission is accorded.
4. Petitioner seeks regular bail in connection with Mithanpura P.S. Case No. 73 of 2023 dated 20.02.2023 registered for the offences punishable under Sections 379, 411/34 of the Indian Penal Code.
5. The main submissions advanced by learned counsel Mr. Manindra Kishore Singh appearing for the petitioner are that in the alleged crime of theft the name of this petitioner
Patna High Court CR. MISC. No.45548 of 2023(2) dt.28-07-2023 2/2 came into light in the confessional statement of co-accused namely, Mohammad Mumtaj who was arrested in another case i.e Town P.S. Case No. 146 of 2023 that was also registered under Section 379, 411 of the I.P.C. in which the petitioner has got bail and after his arrest in the said case, he was remanded in the present case in which he has been languishing in jail since 23.03.2023 and against him, the investigation has been completed and he is a student of matriculation.
6. Learned APP Mr. Ajay Kumar No. 2 appearing for the State has opposed the prayer for bail.
7. Having regard to the facts and circumstances of this case, considering the above submissions and mainly petitioner's young age and the completion of investigation against him, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Mithanpura P.S.
