JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-03-2017 The petitioner is apprehending his arrest in connection with Bhagwan Bazar P.S. Case No. 225 of 2016, registered for offences punishable under Sections 147, 149, 188, 447, 448, 353, 427 and 295 of Indian Penal Code.

It has been submitted on behalf of the petitioner that only general and omnibus allegation has been levelled against the petitioner as he along with several persons were damaging Imambada, the said fact will also appear from impugned order that no specific allegation has been attributed to this petitioner. Learned counsel for the State also could not controvert the aforesaid fact.

Having heard both sides, in view of the fact that no specific allegation has been levelled against the petitioner rather

No.12434 of 2017 (2) dt.24-03-2017 2/2 general and omnibus allegation has been made, as such, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Chapra, District - Saran, in connection with Bhagwan Bazar P.S. Case No. 225 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. It is also made clear that if the petitioner again found involved in any of such offence, in future, his bail bonds will be cancelled.
