JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-06-2018 Petitioner apprehends her arrest in connection with Complaint Case No. 808(C) of 2016 lodged for the offences punishable under Section 406 of the Indian Penal Code. Allegation is that petitioner has taken a loan of Rs.1.5 lakh from the complainant and has not returned the same. Submission of learned counsel for the petitioner is that petitioner has given the interest amount on the same and her husband was ill as such she could not deposit the same and if reasonable time is given she will deposit the same. Heard learned APP and learned counsel for the informant. They have opposed the prayer for anticipatory bail.

No.13616 of 2018 (3) dt.28-06-2018 2/2 Having heard both sides and in the facts and circumstances, this application is disposed of with a direction to the petitioner to surrender within a period of eight weeks along with a Bank Draft of Rs.50,000/- payable in the name of complainant and petitioner shall be released on provisional bail for a period of five months and in the meantime she will deposit rest amount of Rs.1 lakh in five equal instalment payable to the complainant in first week of every month. On failure to deposit any of the instalment her bail bond shall be cancelled. It is made clear that once total amount is deposited, her bail bond shall be confirmed.
