The petitioners seek bail in connection with Special Case No. 4125 of 2021 arising out of Parsa Bazar P.S. Case No. 235 of 2021 dated 07.07.2021 instituted for the offences under Sections 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. The petitioners are the driver and one of the occupants of the vehicle respectively from where 200 liters of liquor was recovered.
Patna High Court CR. MISC. No.54949 of 2021(2) dt.26-05-2022 2/2 The petitioners claim to be the innocent as they had only driven the vehicle to a particular destination on the asking of the garage owner where the petitioners have been working as mechanics.
Three persons were arrested at the time of the raid and the other one apart from two petitioners herein has been granted bail by a coordinate Bench of this Court.
The petitioners are in custody since 08.07.2021 and they do not have other criminal case lodged against them apart from the present one.
Considering the nature of accusation and the period of custody, the petitioners are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise), Patna in connection with Special Case No. 4125 of 2021 arising out of Parsa Bazar P.S. Case No. 235 of 2021.
