Perused the order dated 19.05.2016 passed by the learned Sub Judge X, Siwan in Title Suit No.437 of 1998. The Court below has narrated the conduct of the petitioner. It appears that by this conduct of the petitioner, the date of judgment of the suit was recalled twice and the petitioner has now for the third time has filed the same type of application. The Court observed that this is the delaying tactics of the petitioner. The Mahadanama sought to be exhibited is of prior to the present suit of the year 1998. Admittedly, no suit for specific performance on the basis of the agreement has been filed by the petitioner. In view of the above fact, I agree with the finding of the
