JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 20-04-2016 This application seeking review arises out of a common judgment and order dated 22.05.2015 passed in CWJC No. 10872 of 2015 and several other matters including an application filed by the review petitioner being CWJC No. 12420 of 2009. The purpose of the present application seeking review of the order dated 22.05.2015 with respect to CWJC No. 12420 of 2009 is only to bring to the notice of this Court an office order dated 12.01.2015 issued by the Director ( Secondary Education), Bihar, whereby the office order No. 18P dated 17.01.2011 cancelling approval of service of the petitioner has been

withdrawn. This Court had dismissed her application since the said order, dated 17.01.2011 was not challenged by the petitioner. Learned counsel for the petitioner has submitted that for all practical purpose, the petitioner's claim as on the date of the judgment and order under review i.e. 22.5.2015 had become infructuous, which fact could not be brought to the notice of this Court.

A counter affidavit has been filed on behalf of the Respondent Nos. 1 and 2 wherein this fact has not been disputed, rather, admitted.

This review application stands disposed of taking note of pleadings as above. The judgment and order of this Court dated 22.5.2015 in paragraph nos. 39 and 40 shall be treated to have been modified accordingly.
