IN THE HIGH COURT OF JUDICATURE AT PATNA
Criminal Miscellaneous No.14753 of 2017 Arising Out of PS.Case No. -155 Year- 2016 Thana -BARAULI District- GOPALGANJ ======================================================
1. Batak Kumar Manjhi Son of Prabhu Manjhi @ Parma Manjhi, Resident of Village- Kahala, P.S. Barauli, District- Gopalganj .... Petitioner
Versus
1. The State of Bihar .... Opposite Party ====================================================== Appearance :
For the Petitioner : Mr. Rajesh Roy, Adv. For the Opposite Party : Mr. Ramesh Chandra, APP 54 ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 07-04-2017 Heard the learned counsel for the petitioner and the State.
This is a petition for grant of anticipatory bail for offence under Sections 401, 413, 414, 420, 411, 467, 468 and 471 of the Indian Penal Code.
From before the house of this petitioner a pulsar motorcycle was recovered and the petitioner has no explanation about that.
In the circumstances, I do not find that allegation against the petitioner is similar to co-accused, Manoj Singh, who has been granted anticipatory bail in Cr. Misc. No. 533331 of 2016 by a coordinate Bench.
Prima facie presumption of being in possession of stolen motorcycle is there against the petitioner, hence, I am not inclined to enlarge the petitioner on anticipatory bail.
The prayer for anticipatory bail is refused.
