1. Heard learned counsel for the petitioner and the learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Kadamkuan P.S. Case No. 272 of 2023 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

3. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. From perusal of seizure list, it is apparent that the alleged recovery has been made from the house of Sanjay Sahni. Nothing has been recovered from the conscious possession of this petitioner.

4. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below

Patna High Court CR. MISC. No.46738 of 2023(2) dt.11-08-2023 2/2 within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Patna in connection with Kadamkuan P.S. Case No. 272 of 2023, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
