2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 420, 406, 467, 468, 471, 506, 34 and 120B of the IPC in connection with Gandhi Maidan P.S. Case No.81 of 2024.
3. The learned counsel for the petitioners submit that petitioners are persons with clean antecedent and have been falsely implicated in the instant case by the informant.
4. The learned APP, Mr. Chandra Bhushan Prasad submits that co-accused Kamesh Kumar had approached this Court seeking anticipatory bail by filing Cr. Misc. No.47055 of 2024 and his anticipatory bail application was rejected by an
Patna High Court CR. MISC. No.48745 of 2024(2) dt.20-08-2024 2/2 order dated 20.08.2024 after considering the case on merits. It is also submitted that the case of the petitioners if not akin is similar to the case of Kamesh Kumar, the only difference is that petitioners have purchased 37 decimals of land for an amount of Rs.40,00,000/- within the district of Patna.
5. Considering the submissions made by the learned APP, the Court is not inclined to extend the privilege of anticipatory bail to the petitioners, accordingly, the anticipatory bail application is rejected.
