The petitioner apprehends his arrest in connection with Gogri P.S. Case No. 215 of 2016 registered for the offence punishable under Sections 419, 420 of the Indian Penal Code. The petitioner happens to be Panchayat Secretary of Mushkipur Panchayat. The allegation is that in course of surprise inspection by the Sub Divisional Officer, Gogri, it was found that the petitioner was getting the Ration/Kerosene coupon distributed through the private persons.
Learned counsel for the petitioner submits that the allegation is purely vague. There is no mention of the private persons who were found distributing the ration coupon. There is
Patna High Court Cr.Misc. No.13094 of 2017 (2) dt.18-03-2017 2/2 no substantive evidence to suggest his implication in the present case. The petitioner has got no criminal antecedent. Considering the aforesaid facts and circumstances of the case, the anticipatory bail application is allowed. The petitioner, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Brajesh Kumar, J.M. 1st Class, Khagaria in connection with Gogri P.S. Case No. 215 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
