Petitioners apprehend their arrest in Bind P.S. Case No.65 of 2019 registered under Section 307 and other sections of the Indian Penal Code.
The informant named Murari Ravidas and his three sons and alleged that they all entered into his house and began to assault the informant, his two sons and his wife and took Rs.20,000/- and mobile.
Learned counsel for the petitioners submits that
Patna High Court CR. MISC. No.42626 of 2019(2) dt.10-07-2019 2/3 petitioner no.1 is own brother of the informant. Petitioner nos.2 and 3 are sons of petitioner no.1. The informant alleged that the petitioners indiscriminately assaulted the informant, his sons and wife, but from perusal of the case-diary, it would appear that the informant got two superficial injuries on his head. The injuries are simple in nature. His son Srikant Ravidas and Santosh Kumar also got superficial and simple injury. Lalti Devi also got superficial and simple injury. There is also a counter version.
Having considered the facts and the nature of allegation made against the petitioners and the fact that the informant and petitioner no.1 are own brothers and on account of some family dispute, both entered into scuffle and assaulted each other but the injuries found on the person of informant, his wife and his sons are superficial and simple in nature, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IV, Nalanda at Bihar Sharif in connection with Bind P.S. Case No.65 of 2019, subject to the
Patna High Court CR. MISC. No.42626 of 2019(2) dt.10-07-2019 3/3 conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
