JUSTICE SANJAY PRIYA ORAL ORDER 02-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Sections 341m 323, 354 and 504 of the Indian Penal Code.
It has been submitted that a title suit is pending between the parties. The informant is own sister-in-law (Bhabhu) of the petitioner. On account of land dispute, he has falsely been implicated in this case.
As per the allegation, the petitioner assaulted the informant with lathi and also torn her blouse. Besides this, there is no any specific overt act against the petitioner. Considering the aforesaid facts and circumstances of the case, let the petitioner above named in the event of surrender
Patna High Court Cr.Misc. No.3143 of 2017 (2) dt.02-02-2017 2/2 within six weeks from the date of receipt of this order, in connection with Rajpur P.S. Case No. 169 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
