Petitioner is in custody in connection with Ahiyapur P.S. Case No. 35 of 2019 for the offence under sections 399, 402, 414, 412 of the Indian Penal Code and section 25(1-B) A, 26, 35 of the Arms Act.

Learned counsel for the petitioner would submit that on a secret information that large number of criminals assembled at Vijay Chapra near zero mile to commit big crime, the police force reached the place and apprehended seven persons and others fled away.

Name of the petitioner was disclosed by the persons who were arrested by the police that this petitioner was among the persons who fled away.

Considering the fact that petitioner was not apprehended at the place of occurrence, nothing was recovered from his possession and he has remained in custody for more than three months, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with Ahiyapur P.S.
