2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 8(c)/21(b) of the Narcotic Drugs and Psychotropic Substances Act.

3. As per the prosecution case, total 101.60 grams Smack (Brown Sugar) was recovered from the conscious possession of co-accused Ritesh who disclosed the name of this petitioner.

Learned counsel appearing for the petitioner is innocent and has falsely been implicated in this case. Nothing incriminating article has been recovered from the conscious possession of this petitioner. The petitioner has no concern with alleged recovery. The petitioner has been made accused in the

Patna High Court CR. MISC. No.47351 of 2024(2) dt.19-08-2024 2/2 confessional statement of apprehended co-accused Ritesh Kumar. The petitioner has got one criminal antecedent and in that case he is on bail.

Learned A.P.P. for the State has opposed the prayer for grant of anticipatory bail to the petitioner. 6.

Considering the aforesaid facts of the case, this anticipatory bail is allowed, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, N.D.P.S. Act, Purnea in connection with Sarsi P.S. Case No. 76 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Ranjeet/- U T
