The petitioner seeks bail in connection with a case registered for the offence punishable u/s 302/34 of the IPC. 3.

As per the prosecution case, son of the informant has been stabbed to death by unknown miscreants.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence as alleged in the FIR. He is not named in the F.I.R. and his name transpired on the basis of confessional statement of a co-accused namely Rajan Sharma, who was apprehended by the police in course of investigation. There is general and omnibus allegation against the petitioner and there is no eye-witness to the alleged

Patna High Court CR. MISC. No.48747 of 2024(2) dt.07-08-2024 2/2 occurrence. The petitioner has no criminal antecedent and has been languishing in custody since 22.04.2024 and some of the co-accused has been granted regular bail by co-ordinate Bench of this Court.

Learned APP for the State opposed the prayer for bail. 6.

Considering the facts and circumstances of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/Successor Court in connection with Kesariya P.S. Case No.435/2022.
