Md. Shakir Ahmad, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 29-09-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 379 and 34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and petitioner no.1 is a woman, petitioner no.2 is aged about 18 years and petitioner no.3 is aged about 21 years and the informant alleges that in the intervening night of 1/02.622 these petitioners committed theft of bike of Rakesh Kumar

Patna High Court CR. MISC. No.44892 of 2022(2) dt.29-09-2022 2/3 and they are habitual offenders of commit theft of bike in the vicinity, it is next submitted that they indulged in committing theft of bike by making plan in the house of petitioner no.1.

Learned counsel for the petitioners submits that petitioners have been falsely implicated in the present case, it is next submitted that the allegations are cryptic and vague, it is also submitted that based on suspicion, the present FIR came to be instituted. It is next submitted that though it is alleged that petitioners are habitual offenders but they are persons with clean antecedent.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection
