2. The petitioner in the present case is seeking prearrest bail in connection with Korma P.S. Case No.- 51 of 2023 registered for the offences punishable under Sections 409/ 420/ 34 of the Indian Penal Code. He has got three criminal antecedents.

3. Learned counsel for the petitioner submits that in Ward No. 3 of village Gagaur under Plan No. 04/19-20 and Plan No. 03/2019-20 of Gram Panchayat Raj, the work of earth filling and lying bricks, was checked by Sri Amit Kumar, Senior Deputy Collector, Sheikhpura. In which, the then President Premlata Devi, Ward Secretary Ranjit Kewat, Mukhiya Rubi Ranjana Kumari, Technical Assistant Ranjit Kumar Singh and Panchayat Secretary Vidyanand Prasad have been found guilty

Patna High Court CR. MISC. No.50413 of 2023(2) dt.23-08-2023 2/3 of irregularity in the work. The accused persons are jointly involved in mis-appropriation of public money.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. It is submitted that there is no specific allegation against this petitioner.

5. Learned APP for the State has opposed the prayer for anticipatory bail of the petitioner.

Having regard to the nature of allegation and the observations present in the order of the learned Sessions Judge, Sheikpura based on Paragraph '43' of the case diary that a sum of Rs. 4,25,000/- has been shown in the measurement book by Junior Engineer in connivance with the then Panchayat Secretary, then Gram Panchayat Mukhiya, Ward member and Ward Secretary and in the another work Rs. 5,00,214/- in the book in similar manner without doing any work and this person is the Technical Assistant who has prepared the measurement book, this being a case of mis-appropriation of public money, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

7. The prayer for anticipatory bail of the petitioner is refused.

8. In case the petitioner surrenders and prays for regular bail in the court below within a period of four weeks from today, his prayer shall be considered on its own merit without being prejudice by the order of this Court.
