Mandal for the State.

The application seeks restoration of MJC No. 3122 of 2015, which was again filed for restoration of MJC No. 3477 of 2014.

The writ application of the petitioner was disposed of on 23.10.2013. Finding non-compliance thereof, the petitioner filed MJC No. 3447 of 2014, which was dismissed for want of prosecution. The restoration petition (MJC No. 3122 of 2015) was dismissed noticing the fact that despite repeated calls,

Patna High Court MJC No.3122 of 2015 (3) dt.31-08-2016 2/2 no one had appeared to press the same. Now, the present application is filed for restoration of the aforesaid restoration application.

The contention of the counsel for the petitioner is that the name of the counsel was not correctly printed in the cause list.

On hearing the parties, this Court is not inclined to allow this restoration application and restore another restoration application. If the cause survives, the petitioner would be at liberty to file a fresh application for initiating the contempt proceeding.

Observing above, the present restoration application is dismissed.
