The petitioners seek bail in anticipation of their arrest in connection with Bajpatti P.S. Case No. 204 of 2020, dated 01.06.2020, instituted for the offences under

Patna High Court CR. MISC. No.5078 of 2021(2) dt.10-09-2021 2/3 Sections 341, 323, 307, 354(B), 379, 337, 504, 506 and 34 of the Indian Penal Code.

The accusation in the F.I.R. is that over the issue of throwing the torch light on the face of the informant, a verbal fight took place and as a consequence of that, many persons arrived at the scene and started assaulting the family members of the informant.

It has been submitted that the petitioners and the informant are neighbours, who have some dispute from before. On such a lame pretext of the torch light being thrown on the informant, the occurrence is alleged to have taken place, which does not appear to be trustworthy. It has further been submitted that two of the persons who have been injured in the occurrence have received only simple injuries. The accusation against the petitioners is general and omnibus. So far as the act of assault is concerned, it is attributed to other accused persons of this case. Regard being had to the facts afore-stated and taking into account the gender of the petitioners, they, in the event of their arrest or surrender before the learned Court

Patna High Court CR. MISC. No.5078 of 2021(2) dt.10-09-2021 3/3 below within a period of eight weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Bajpatti P.S. Case No. 204 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
