2. The petitioner apprehends his arrest in connection with Sarsi P.S. Case No. 76 of 2024 registered under Sections 8(c)/21(b) of N.D.P.S. Act.
3. As per prosecution case, total 101.60 grams Smack (Brown Sugar) was recovered from the conscious possession of co-accused Ritesh Kumar who disclosed the name of this petitioner.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that the name of the petitioner has come merely on the confessional

Nothing incriminating article has been recovered from the conscious possession of the petitioner. It is further submitted that similarly situated co-accused Sonu Kumar @ Sonu Bishwas has already been granted anticipatory bail by this Court vide order dated 19.08.2024 passed in Cr. Misc. No. 47351 of 2024.
5. Learned A.P.P. for the State opposed the prayer for bail.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Judge, N.D.P.S. Act, Purnea in connection with Sarsi P.S. Case No. 76 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
