Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner apprehends his arrest in connection with Sahiyara P.S. Case No. 93 of 2020 registered for the offence under Sections 341, 323, 307, 380 of the Indian Penal Code. The prosecution story in nutshell is that in the night on 27.04.2020 at 2:00 A.M., petitioner/accused committed theft after entering into the house of the informant and on protest inflicted dabiya blow upon informant, causing head injury and fled away after taking ornaments as well as after giving dash to his wife.

It is submitted on behalf of the petitioner that informant doing

No.42 of 2021(3) dt.14-12-2021 2/2 a business of illegal country made liquor and police raided the house of the informant on 06.01.2020 on basis of information of the petitioner and recovered huge quantity of illegal country made liquor and instituted the case against the informant as Sahiyara PS. Case No. 07 of 2020. When the informant learnt about the petitioner that the petitioner had informed the police, he became annoyed and got the present case instituted against the petitioner.

In the occurrence, informant as alleged has sustained three injuries. The Doctor opined that injury no. 3 is simple in nature and injury nos. 1 and 2 result will be ascertained after treatment. In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest of surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sitamarhi in connection with Sahiyara P.S. Case No. 93 of 2020, subject to conditions as laid down under Section 438 (2) of the Cr.P.C. (Sunil Kumar Panwar, J) pravinkumar/- U
