JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-02-2017 The petitioner is apprehending his arrest in connection with Hathauri P.S. Case No. 50 of 2008, registered for offences punishable under Section 306 of the Indian Penal Code. It has been submitted on behalf of the petitioner that petitioner happens to be the husband of the informant and though the case is of the year 2008, the charge-sheet has not yet been filed in this case, even after lapse of about nine years and in the meantime a compromise petition has also been filed by the informant of this case stating that the case has wrongly been filed by her.

Heard learned A.P.P. also.

Having heard both sides, in view of the submissions of learned counsel for the petitioner, let petitioner surrenders before

Patna High Court Cr.Misc. No.6270 of 2017 (2) dt.21-02-2017 2/2 the Court below and pray for regular bail and make the above submissions, which will be considered by the Court below as well the merit of the case and shall dispose of the application of the petitioner, without being prejudiced by the order of this Court, With the above observation, this application is disposed of.
