This application for anticipatory bail arises out of Patna Mahila P.S. Case No. 119 of 2018 for the offence punishable under Sections 354(C) /354(D), 376, 120B, 420/34 of the Indian Penal Code and under Section 3/4 of the Dowry Prohibition Act.

Learned counsel for the petitioner has produced before me an order dated 23.06.2020 passed in Criminal Miscellaneous No.9431 of 2020, by which similarly situated coaccused namely, Anand Dev has been granted anticipatory bail by a coordinate Bench of this Court.

For the reasons mentioned in the order dated 23.06.2020 passed in Criminal Miscellaneous No.9431 of 2020, this application is allowed. Let the petitioner, above named, in

Patna High Court CR. MISC. No.4297 of 2021(2) dt.17-11-2021 2/2 the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Patna, in connection with Patna Mahila P.S. Case No. 119 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. However, initially the Court below will release the petitioner on provisional bail and call for a report from the Superintendent of Police, Nawada and Superintendent of Police, Nalanda, about the criminal antecedents of the petitioner. If it is found that the petitioner has clean antecedent, the provisional bail granted to the petitioner shall be confirmed otherwise the provisional bail of the petitioner shall be cancelled.
