JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-12-2018 After some argument, the learned counsel for the petitioner seeks to withdraw the present writ petition to file objection under Section 9 of the Bihar & Orissa Public Demand Recovery Act, 1914 and till that time the petitioner seeks some protection.

Accordingly, the present writ petition is disposed of as withdrawn with liberty to the petitioner to file an objection under Section 9 of the Bihar & Orissa Public Demand Recovery Act, 1914 in Case No. 32 of 2011-12, pending before the Certificate Officer, Vaishali at Hajipur.

It is further directed that in case the petitioner files objection under Section 9 of the Act, the Certificate Officer

Patna High Court CWJC No.13057 of 2016(2) dt.03-12-2018 2/2 shall be obliged to pass final order.

Till the disposal of the Certificate Case, no coercive steps shall be taken against the petitioner if not already taken. However, it is made clear that in case the petitioner does not file any fresh objection within a period of four weeks from today, the Certificate Officer shall proceed ex parte.
