Mr. Krishna Chandra, learned counsel appearing on behalf of the petitioner informs this Court that due to laches on the part of the previous Executive Officer, the draft submitted by the petitioner in lieu of the penalty imposed having not been encashed by the Executive Officer and petitioner has been again penalised by the action of the Executive Officer, who has not

3. Considering the aforesaid information given by the petitioner and view of the paragraph no. 11 of the counter affidavit filed on behalf of the respondent no. 4- The Executive Officer, Nagar Parishad, Dehir- Dalmia Nagar, the Executive Officer is directed to make a request to the petitioner by giving him 'No Objection Certificate' to revalidate the draft as the same has not been encahsed due to inaction of predecessor of the present Executive Officer.

4. The Petitioner is directed to cooperate with the Executive Officer by furnishing a fresh draft or get the draft, which is expired for its revalidation.

5. All the above exercise is directed to be done within a period of one week without delaying to issue 'No Objection Certificate' to the petitioner.

6. With aforesaid observations and directions, the present writ petition is disposed of.
