2. The petitioner is in custody since 05/08/2023 in connection with K. Hat P.S. Case No. 919 of 2023 registered for the offence punishable under Sections 8(c)/21(b) of NDPS Act.

3. As per the prosecution case, 37 grams of Smack and Rs. 7040/- have been recovered from the possession of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that nothing incriminating has been recovered from the possession of the petitioner. He further submits that the petitioner is not involved in any case under NDPS Act and recovery is of intermediate quantity. The petitioner is in jail

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

6. Considering the period of custody, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge cum Special judge (NDPS Act)/ concerned court in connection with K. Hat P.S. Case No. 919 of 2023.

7. The petitioner is directed to mark his attendance in K. Hat police station on 1st Sunday and 3rd Sunday of every month. Failure to do so, will result in cancellation of bail bond of the petitioner.
