The petitioner is apprehending his arrest in connection with Dalsingsarai P.S.Case no.431 of 2016 registered for offences punishable under Sections 393, 398, 302 and 120B of the Indian Penal Code and Section 27 of the Arms Act.

Petitioners are not named in the FIR and later on his name transpired during the course of investigation of the case. The case is under Section 393, 398 and other Sections of the IPC. Submission of the learned counsel for the petitioner is that on confession, the name of the petitioner has transpired and even in the confession there is no allegation of assault against the petitioner and he has no criminal antecedent. Heard learned A.P.P. also.

No.16772 of 2018 (3) dt.15-05-2018 2/2 Having heard both sides and in view of nature of allegation, this is not a case for grant of anticipatory bail rather let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on its own merit.
